It’s unfortunate we don’t have clearer rights surrounding freedom of speech here in Canada.As well there seem to be a lot of confused Americans (and unfortunately also Canadians) here that seem to not understand that our justice system is fundamentally different than the American one.Here our laws are enforced “in the spirit of the law” vs the American “to the letter of the law”Basically our laws are enforced based on what they’re meant to embody, not the strict definition of what’s been printed.Our federal laws most often even contain an “interpretation section” that explains why the law exists and how its meant to be interpreted.Basically, just because you break a law here, doesn’t mean the judge has to convict you, and just because you technically didn’t by the strictest definition, doesn’t mean he has to let you off.So if you make a single comment off hand, and someone decides to make a thing of it, even if you technically broke the law, the judge isn’t going to charge you.Add to that the fact that our justice system leans towards teaching you to be better, and not punishment, and 99% of the silly scenarios people are pointing out here will never happen. Our judges don’t punish you unless they think you truly deserve it.
